Travel planner: refers to the service provided by the company, consisting in planning trips for customers.

Client: refers to any person using the travel planner service.

Party: designates either the travel planner or the client.

Objective
The travel planner provides a travel planning service for customers, using best practices and the best suppliers to ensure enjoyable and hassle-free trips.
Service delivery

The travel planner provides personalized tourist advice to customers, without including the reservation of tickets or accommodation.

The tourist recommendations are based on the information provided by the customer during the request. The customer is responsible for the truthfulness and accuracy of this information.

The travel planner will endeavor to provide accurate and timely tourist advice, but cannot guarantee the availability or accuracy of information on tourist sites, accommodation, transport, etc.

Price and payment

The price for tourist advice is indicated on the travel planner's website or on an invoice sent to the client.

Payment is due upon receipt of invoice and can be made by bank transfer or credit card, depending on the options available.

No refunds can be made once tourist advice has been provided.

Privacy

The travel planner undertakes to protect the confidentiality of the information provided by the client.

The information will be used only to provide tourist advice and will not be shared with third parties without the authorization of the client.
​
Limitation of Liability

The travel planner will not be liable for any loss or damage suffered by the client due to the use of the tourist proposals provided.

The customer assumes full responsibility for planning their trip and for all decisions made based on tourist advice.
​
Intellectual property

The tourist advice provided by the travel planner is protected by copyright and intellectual property laws.

The customer undertakes not to reproduce, distribute, sell or use in any way the tourist advice without the prior written authorization of the travel planner.

Cancellation and refund

Given the nature of tourist advice which excludes the reservations involved from the services purchased, no cancellation or refund policy is applicable.

However, if the customer is not satisfied with the tourist advice provided, he can contact the travel planner within 48 hours to discuss a possible solution.
Applicable law

These general conditions of sale are governed by the applicable law of the country in which the travel planner is based.

In the event of a dispute, the parties undertake to try to resolve the dispute amicably before going to the competent courts.

Dispute Resolution Provisions

Jurisdiction: All disputes arising out of or relating to the purchase of tourist tips will be subject to the jurisdiction of the courts of Krakow.

Arbitration: The parties agree that any dispute, claim or controversy arising out of or relating to the purchase of Tourist Tips will be resolved by arbitration under the rules of the Krakow Chamber of Commerce and Industry.

Place of Arbitration: The arbitration will take place in Krakow, Poland.
-
Language of arbitration: The language of arbitration will be Polish.

Provisions on the duration of the contract and on the conditions of termination

Duration of the contract: This contract is concluded for a fixed period and will end once the tourist advice is fully provided to the client.

Early termination: The customer may terminate the contract at any time by giving written notice to the travel planner, provided that he has not received tourist advice before said notice.

Termination for breach: The travel planner may terminate the contract in the event of the customer's breach of his obligations under these general conditions of sale.

Effects of termination: In the event of termination of the contract, the customer's obligations not to solicit employees of the travel planner and not to use the information obtained remain in force. The customer will not be entitled to a refund for tourist advice already provided.

Protection of personal data

Processing of personal data. The Travel Planner processes the personal data of the customer in accordance with the legislation in force regarding the protection of personal data.

Purposes of processing. The customer's personal data will be used to provide the purchased tourist advice and to fulfill legal obligations.

Disclosure of Data. The customer's personal data will not be disclosed to third parties without the express consent of the customer, unless required by law.

Right of Access and Correction. The customer has the right to request access to his personal data stored with the Travel Planner and to correct them if they are inaccurate.

Data security. The Travel Planner takes appropriate security measures to protect the customer's personal data against loss, misuse, unauthorized modification or accidental disclosure.

Modification of the general conditions of sale

The travel planner reserves the right to modify these general conditions of sale at any time, by informing the customers in writing.

The changes will come into effect from the date of notification.

Non-solicitation clause
The client agrees not to, directly or indirectly, solicit, hire or take steps to hire any current or former employee of the travel planner during the term of the contract and for a period of 12 months after the termination of the contract. The customer also agrees not to disclose to third parties any confidential information about the employees of the travel planner. In case of violation of this clause, the customer will be required to pay a fixed penalty of 1000 euros.

Acceptance of the general conditions of sale

By using the services of the travel planner, the customer accepts these general conditions of sale.
